Appeal of the Non-governmental Organisations of Georgia
November 7, 2007
We non-governmental organizations of Georgia condemn the violent actions taken by the Georgian state authorities on November 7, 2007 with the pretext of restoring law and order in the capital city, as a result of which peaceful protesters were attacked in the streets and pursued for expression of their opinion.
We the non-governmental organizations of Georgia deem those violent actions as unlawful and damaging the interests of Georgia’s statehood and the democratic principles which our country adheres to. The climax of the developed process was the crack-down on the independent TV company “Imedi TV”, followed by forceful closure of other independent media sources (“Caucasia TV” and Radio “Imedi”).
We the non-governmental organizations of Georgia are stressing that this is an evident attempt by the Georgian state authorities to establish a dictatorial regime in Georgia. We appeal to the international organizations and the international community to help Georgian people to rescue democracy in our country.

სტრასბურგი, 12.11.2007 - ევროპის საბჭოს საპარლამენტო ასამბლეის სამონიტორინგო კომიტეტის თანამომხსენებლებმა ბ-ნ მატიას იორშიმ (უნგრეთი, ლიბერალური, დემოკრატიული და რეფორმების ჯგუფი - ALDE) და ბ-ნ კასტრიოტ ისლამიმ (ალბანეთი, სოციალისტთა ჯგუფი - შOჩ), მოიწონეს პრეზიდენტ სააკაშვილის განცხადება ადრეული საპრეზიდენტო არჩევნების დანიშვნის შესახებ.
მათ დასძინეს, რომ საქართველოს მთავრობისგან მოელოდნენ საგანგებო მდგომარეობის შეძლებისდაგვარად მალე გაუქმებას და მოუწოდეს ქვეყანას სრულად აღდგეს დემოკრატიული პროცესების ნორმალური ფუნქციონირება. მათ შეახსენეს საქართველოს ხელისუფლებას ნებისმიერი ქმედების დროს მკაცრად ერთგულნი დარჩნენ კანონის უზენაესობის პრინციპებისადმი და მისდიონ ადამიანის უფლებათა ევროპულ კონვენციას, განსაკუთრებით გამოხატვის, ინფორმაციის და შეკრების თავისუფლებასთან მიმართებაში.

HIGH COMMISSIONER ALARMED ABOUT GEORGIA STATE OF EMERGENCY

United Nations High Commissioner for Human Rights Louise Arbour said today she was following with concern developments in Georgia, where a state of emergency has been imposed.
The High Commissioner said she was particularly worried over reports of disproportionate use of force, including against Georgia’s Public Defender, the detention of opposition leaders and the beating of demonstrators. She also expressed concern that independent television stations have reportedly been raided by special forces and made to stop broadcasting.
The High Commissioner expressed her support for the Public Defender and stressed that his independence and inviolability must be respected at all times.
Georgia is a state party to the International Covenant on Civil and Political Rights which stipulates that fundamental rights, such as the right to life, the prohibition of arbitrary detention, torture and cruel, inhumane and degrading treatment, cannot be suspended, even in times of emergency. Any restriction of rights must be proportionate and may only be applied to the extent and for the time strictly required by the situation, the High Commissioner recalled.

(New York, November 8, 2007) – For the second day, riot police used violence to disperse peaceful protests, this time using force against a small group of students in the Black Sea town of Batumi in western Georgia, Human Rights Watch said today. Riot police again filled the streets of the capital, Tbilisi, during the first day of a 15-day state of emergency declared on November 7, 2007 by President Mikhail Saakashvili in response to earlier anti-government demonstrations and an alleged coup attempt.
At approximately 9:30 a.m. on November 8, a few hundred students gathered at Batumi State University to protest the police violence against peaceful demonstrators in Tbilisi the previous day. Eyewitnesses interviewed by Human Rights Watch said that police attacked the group without warning, chasing and beating protesters trying to flee.
“This government came to power on a wave of nonviolent protest, so it should understand the importance of letting people express their opinions,” said Holly Cartner , Europe and Central Asia director at Human Rights Watch. “Beating protestors and imposing a virtual media blackout goes against the principles Saakashvili’s government was founded on.”
Georgia’s residents, who rely on television as their main news source, have little information about what is happening in the country. The government shut down two private Georgian television stations prior to the state of emergency declaration yesterday. The local cable company suspended BBC, CNN and other international news broadcasts today. The presidential decree on the state of emergency prohibits television and radio stations from broadcasting, with the exception of the state-funded Georgian Public Broadcaster. Although the restrictions on media do not apply to newspapers or the internet, most newspapers have a small circulation and only 7 percent of the country has access to the internet. In Tbilisi, all newspapers were sold out by midday today.
A Human Rights Watch representative interviewed several students, a professor and a journalist who witnessed the police dispersal of the demonstration in Batumi on November 8. About 30 to 50 masked riot police descended on the group of students and then chased and beat students who tried to flee. The police issued no warning prior to attacking the crowd. One witness described how five police beat one student, who accidentally fell on the stairs after running into the university building. Riot police chased other students into classrooms. Some students broke ground-floor windows in attempts to flee. The police also used tear gas to disperse the students. Georgia’s Public Broadcaster reported that seven students were injured and hospitalized, but were soon treated and released.
Under the president’s state of emergency decree, public assembly has been banned throughout the country. However, contradictory statements by senior government officials late last night appear to have left the students unaware that the ban applied to all of Georgia, rather than just Tbilisi. At 10 p.m. on November 7, Prime Minister Zurab Nogaideli announced that the state of emergency would be restricted only to Tbilisi. But at 1 a.m. on November 8 the economy minister, Giorgi Arveladze, announced that the state of emergency was imposed throughout the country. Participants in the Batumi protest told Human Rights Watch that, had they known the ban on protests was country-wide, they would not have participated in the demonstration.
“In an emergency, the Georgian government can restrict some rights, but it can’t send the police in to beat up peaceful protesters,” said Cartner. “The government should investigate all reports of police beatings and prosecute those found to have used excessive force on demonstrators.”
At 7 p.m. today, President Saakashvili announced snap presidential elections for January 5, 2008 and a referendum on the timing of parliamentary elections, apparently in an attempt to diffuse the crisis. The 15-day state of emergency remains in force and will be presented to parliament tomorrow for approval.
The International Covenant on Civil and Political Rights (ICCPR), to which Georgia is a party, states that governments have the right to declare a state of emergency during “a public emergency which threatens the life of the nation.” Not every disturbance or catastrophe qualifies as a public emergency which threatens the life of the nation, and governments must clearly justify the decision to proclaim a state of emergency. Under a state of emergency, governments may only limit rights and freedoms to the extent strictly required by the situation. Governments must at all times guarantee the right to life, the prohibition against torture and ill-treatment, the right to liberty and security of person, the right to a fair trial, and freedom of thought, conscience and religion, among other rights. The European Convention on Human Rights also provides similar protections.

Georgia: Riot Police Violently Disperse Peaceful Protesters
Government Shuts TV Stations, Then Declares Emergency Rule
(New York, November 8, 2007) – Riot police in the Georgian capital Tbilisi beat demonstrators and shot fleeing protestors with rubber bullets while trying to disperse anti-government demonstrations, Human Rights Watch said today. Riot police later raided the private television station, Imedi TV and forced it and the Kavkasia television station to stop broadcasting. The Georgian government then declared a state of emergency, claiming there had been a coup attempt, and banned news broadcasts for 15 days, except by the state-funded Georgian Public Television.
“Even in a time of crisis, Georgians have a right to protest peacefully without being beaten by the police,” said Holly Cartner, Europe and Central Asia director at Human Rights Watch. “Firing rubber bullets at peaceful demonstrators is a complete abuse of the use of force. The government does not have a carte blanche to restrict fundamental freedoms just because it is in crisis.”
The protest rally started on November 2, 2007, when tens of thousands of protestors, led by the 10-party opposition coalition, gathered outside the parliament on Tbilisi’s main street. The protest organizers had informed the government of their intention to gather at the parliament building, as required under Georgian law. Several thousand protestors continued to demonstrate peacefully for five days outside the parliament.
But in three separate incidents on November 7, riot police in Tbilisi violently dispersed peaceful protestors. At approximately 8 a.m., police evicted a small group that had camped on the steps of parliament, including more than a dozen people on a hunger strike, and arrested several opposition leaders. According to media reports, the police prevented journalists from filming the incident, and confiscated and destroyed several television cameras.
Police remained all morning and prevented demonstrators from blocking Rustaveli Avenue, the main thoroughfare in downtown Tbilisi. By midday, the crowd had grown to several thousand, and demonstrators managed to push the police into Rustaveli Avenue. Riot police attempted to push them back. At 1 p.m., the police warned they would disperse the crowd in order to open the street. They used water cannons, tear gas and rubber bullets to do so.
Uniformed riot police and men in black uniforms and masks chased and beat protestors with rubber truncheons. They also used rubber bullets against the demonstrators. A Human Rights Watch representative witnessed how riot police chased and beat fleeing protestors as they ran into the yard of a nearby church and into nearby streets. The protestors offered no resistance and called on each other not to resist in order not to provoke harsher retaliation from the police.
Around 5 p.m., riot police again attacked opposition demonstrators who had gathered some kilometers away from the parliament. Several thousand protestors outraged by the day’s events had gathered in an area known as Rike, outside the city center. Riot police, without warning, attacked using tear gas, rubber bullets and water cannons. The police chased protestors and shot some in the back with rubber bullets as they tried to flee. Television reports also showed some protestors throwing stones at riot police as they fled. Police beat the leader of the People’s Party, Koba Davitashvili, who was hospitalized and is in critical condition.
The police also appear to have deliberately targeted journalists and independent observers. Two cameramen from Imedi TV were hospitalized, one with severe injuries, because of a beating by the police. Georgia’s ombudsman, Sozar Subari, was also beaten. Riot police attacked him with rubber truncheons as he was documenting the police actions. Subari said in a public statement that he believes he was deliberately targeted because as ombudsman he regularly criticizes the Georgian government for human rights abuses.
Two television stations, Imedi TV and Kavkasia, which were broadcasting extensive coverage of the demonstrations and the police response, were taken off air around 9 p.m. Imedi TV ceased broadcasting shortly after its anchor announced on live television that the riot police had entered the station. Imedi radio station also stopped broadcasting and Imedi’s website became inaccessible. A few minutes later, Kavkasia, which broadcasts only in the capital Tbilisi, also went off the air. Riot police then used tear gas to disperse a small crowd gathered in front of Imedi TV’s offices to protest its closure. Television reports showed dozens of police officers using truncheons to beat one of the protestors. Imedi TV belongs to Rupert Murdoch’s News Corporation, but was founded and co-owned by Badri Patarkatsishvili, a wealthy financier and critic of the government who openly financed the opposition in Georgia.
Later in the evening, the government declared the state of emergency and suspended a number of legal rights.
“Beating journalists or shutting down television stations for reporting on the events can’t be justified by subsequently declaring a state of emergency,” said Cartner.
The exact number of injured is unknown, but the Health Ministry reported that 508 people had sought emergency assistance and some 118 of them remained hospitalized.

Georgia: Authorities must promptly investigate police actions in dispersing demonstrators
Amnesty International is calling on the Georgian authorities to promptly open a thorough, impartial and independent investigation into allegations that special police forces used excessive force when dispersing anti-government demonstrations in the capital, Tbilisi, on 7 November.
Police were said to have used truncheons, rubber bullets, tear gas and water cannons to break up three rallies in Tbilisi, after six days of mass demonstrations led by a coalition of opposition groups in which tens of thousands of people had taken part. Eye-witness accounts received by Amnesty International speak of police beating and kicking demonstrators, with the Georgian Ombudsman among those reportedly beaten. Some 500 people are said to have sought medical treatment, including 24 police officers.
President Mikheil Saakashvilli imposed a state of emergency in the evening of 7 November, and in an address to the nation blamed the Russian special services for stirring unrest and supporting anti-government protests. The state of emergency was initially restricted to Tbilisi for 48 hours but later extended to the whole of the country for 15 days. It restricts the rights to receive and disseminate information (under Article 24 of the Constitution of Georgia), to freedom of assembly (Article 25), and to conduct strikes (Article 33). Two private television stations Б─⌠ Imedi TV and Kavkasia Б─⌠ were forced to stop broadcasting at around 9pm that day, and only the state-owned Georgian Public Broadcaster is allowed to broadcast news during the state of emergency.
In his account of events Sozar Subari, the Ombudsman of Georgia, reported that around 5pm on 7 November he witnessed police beating fleeing demonstrators who had gathered near a church in the centre of Tbilisi. The demonstrators then started to throw stones at the police but desisted at his request. However, another special police unit then arrived and began to beat the demonstrators without warning. When the Ombudsman remonstrated with police officers he saw beating three people who were already on the ground and not putting up any resistance, he himself was kicked and verbally abused by police. One of his staff members, Daniel Mgeliashvili, was also hit over the head when he urged police to refrain from assaulting the Ombudsperson. A foreign freelance journalist reported seeing police dragging people, who appeared not to be involved in the events, out of shops. These included one man said to have been dragged from a pharmacy and beaten by four police officers.
According to Principle 5 of the UN Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, police have the duty to Б─°exercise restraint [Б─і] and act in proportion to the seriousness of the offence and the legitimate objective to be achievedБ─². Police are also required to Б─°minimize damage and injury, and respect and preserve human lifeБ─². Principle 8 stipulates that Б─°exceptional circumstances such as internal political instability or any other public emergency may not be invoked to justify any departure from these basic principlesБ─².
Amnesty International has persistently urged the Georgian authorities to address longstanding concerns about torture and other ill-treatment by law enforcement officials. Last month the UN Human Rights Committee echoed these concerns. While the HRC acknowledged the Б─°significant reduction in allegations of [torture and other ill-treatment] of persons in custodyБ─², it expressed its regret about the persistence of reports involving police abuse, in particular during the arrest of suspects. The Committee also raised concern about deaths allegedly resulting from the use of excessive force by police and prison officials.
In order to eradicate torture, ill-treatment and excessive use of force, the HRC called on Georgia to Б─°take firm measuresБ─², including by ensuring prompt and impartial investigations of allegations, by publishing the results of such investigations, and by bringing the perpetrators to justice.

The Government of President Saakashvili has revealed its authoritarian nature, ordering SWAT teams to violently curb peaceful protest in streets of Tbilisi.
On November 7, 2007 at approximately 5 am Georgian SWAT teams violently dispelled a peaceful manifestation outside the building of Parliament in Tbilisi. Police used teargas, water, rubber bullets and blunt force clubs against peaceful demonstrations.
Opposition leaders who were engaged in a hunger strike and lying on the street were severely beaten. Koba Davitashvili of People’s Party and singer George Gachechiladze are in hospitals in critical conditions. Others face the risk of prosecution on the charges of treason.
Around 5 p.m., riot police again attacked opposition demonstrators who had gathered some kilometers away from the Parliament.
508 people had sought emergency assistance due to injuries and gas poisoning. Some of them are in critical condition. Georgia’s ombudsman, Sozar Subari, was also attacked by riot police with rubber truncheons. Riot police later raided the private television station, Imedi TV and forced it and the Kavkasia television station to stop broadcasting. Later in the evening, the government declared the state of emergency and suspended a number of legal rights. Electronic and print media was prohibited to cover news stories.
For the moment, members of the Parliamentary Majority and the President have made statements, threatening to arrest those that speak against the clampdown.
The protest rally started on November 2, 2007, when tens of thousands of protestors, led by the 10-party opposition coalition, gathered outside the parliament on Tbilisi’s main street. The protest organizers had informed the government of their intention to gather at the parliament building, as required under Georgian law.
Several thousand protestors continued to demonstrate peacefully for five days outside the parliament. They demanded timely parliamentary elections and reform of the election management body and voting system.

1) to interfere urgently in the crisis in Georgia to prevent further casualties and deterioration of situation;
2) to condemn massive violation of human rights by the law enforcement agencies of Georgia;
3) to pressure the Georgian government to stop persecution of opposition members and dissenters;
4) to influence President Mikhail Saakashvili and his government to cancel emergency rule and remove ban from the media;
5) to compel the Georgian government to release all political prisoners
6) To satisfy the appeal of the opposition and people for the peaceful dialogue in order to find acceptable solution via negotiations for conflict resolution.

Мы хотим заявить, что в Вашингтоне уже начата работа по сбору и оценке нарушений прав человека и демократических норм в Грузии. Как и в случае с режимом Звиада Гамсахурдиа, это приведет к быстрым и эффективным результатам.
Мы также хотим заявить, что оголтелая русофобия Саакашвили играет против интересов грузинского народа. Дипломатия не совместима с теми топорными методами, с которыми этот человек пытается решить непростые вопросы с большим северным соседом. Такое поведение не устраивает и Вашингтон, стремящийся избежать излишней конфронтации с Москвой. Разрывая на части собственное общество, насилуя его и ввергая его в пучину демагогии, лжи, фанфаронства и глупости, Саакашвили перерубает нити связи с Западом, которые не он создавал. Ни в НАТО, ни в Европейский союз такие диктаторские антинародные режимы не принимают.
В свое время мы были инициаторами первой в истории резолюции Сената США в поддержку национально-демократического движения Грузии. И сегодня мы хотим заверить вас, что американская политика не будет молча наблюдать, как прикрываясь ею, топчут базисные принципы Америки.
Мы призываем всех грузинских правозащитников, всех бывших политзаключенных, диссидентов, настоящих демократов и патриотов сплотиться, противостоять насилию и лжи властей, информировать мировое сообщество о творимых в Грузии беззакониях. Необходим постоянный мониторинг нарушений прав человека, необходимы все те методы и формы борьбы, которые мы успешно применяли против советских властей и диктатуры звиадизма.

7 ноября 2007 года власти Грузии жестоко разогнали митинг оппозиции на проспекте Руставели в Тбилиси. Против демонстрантов были применены дубинки, резиновые пули, водометы и слезоточивый газ. Сотни людей получили травмы и были доставлены в больницы. Лидеры оппозиции арестованы. Есть сведения, что они подвергаются пыткам, с целью склонить их к оговору. По телевидению демонстрируются записи телефонных разговоров лидеров оппозиции с сотрудниками российского посольства, из чего делается вывод, что лидеры оппозиции виновны в «измене родине» и в сотрудничестве со спецслужбами «вражеского государства», России. Оппозиционный телевизионный канал «Имеди» был захвачен спецназом во время прямого эфира. Вещание прекращено. Сотрудники редакции были избиты и арестованы. Закрыты и другие оппозиционные телеканалы. Аресты проходят по всей Грузии. Выступая с обращением к нации, президент Михаил Саакашвили цинично уверял, что разгон и избиение мирной демонстрации является демократической нормой. Он упирал на то, что слезоточивый газ, которым были отравлены сотни людей, сделан на Западе.
9 ноября в Тбилиси должна была состояться международная конференция по правам человека. Однако, учитывая то, что в республике фактически введен режим чрезвычайного положения и вся верхушка оппозиции арестована, проведение конференции под вопросом.
Следует подчеркнуть, что все грузинские правозащитники, все диссиденты и бывшие политзаключенные советского времени, сегодня выступают против режима Саакашвили.
Михаил Саакашвили представляет себя сторонником западной демократии, чем полностью дискредитирует ее. В Грузии как никогда велик антиамериканизм. Дядя Саакашвили – Темур Аласания был генералом КГБ СССР. Саакашвили кончил Киевский Институт Международных Отношений, после чего пошел на службу в погранвойска КГБ СССР. После этого он был направлен в Европу и в США. Политическую деятельность в Грузии Саакашвили начал как яростный сторонник президента Эдуарда Шеварднадзе.
Известные грузинские диссиденты Тенгиз и Эдуард Гудава, живущие в Вашингтоне, США, обратились к участникам Тбилисской Конференции по правам человека со следующим обращением:

Выборы во время чумы
Заметался президент Грузии, заагонизировал вдруг. Назначил в самый разгар осадного положения досрочные президентские выборы, да на самый канун Рождества Христова, 5 января. Как в фильме «В шесть часов после войны» - через шесть недель после чрезвычайки, которая тут роль рождественского поста символизирует. Так сказать, удушение свободы плавно переходящие в свободные выборы, только без избирательной кампании. Но с избивательной!
У воров во время «сходняка» - скрупулезное исполнение «законности». Полная «свобода» выражать мнение (перед смертью). И широкий спектр выбора: опустить или поднять? «На нож» поставить или на криминальный пьедестал?
Мне все эти родовые муки выборов в полуавторитарных и четвертьдемократических странах больно напоминают такой вот «сходняк», где ясно кто пахан.
Кого выберет вождем племя людоедов, особенно в голодную пору? Миллион наблюдателей ОБСЕ не смогут зафиксировать ни единого нарушения при избрании таковым самого клыкастого и кровожадного.
В выборах первичен не факт голосования, а атмосфера этого события. Выборы – это выбор человека, когда его воля полностью свободна, тотально независима от всего, кроме собственной совести. А если тебя перед выборами хорошенько «помочить» из водомета, потом потравить газом, потом дубинками отходить, прилюдно объявить «предателем», «агентом врага», и изолировать двухнедельным информационным карантином, то в каком ушибленном состоянии подойдет к избирательной урне твоя совесть? Сможет ли доползти до этой урны твоя сломленная воля?
Когда в атмосфере 37 год, а на балконе – новый Аравидзе, и твой телефонный разговор записывают и переписывают мелкие бесы, дабы потом сказать, что ты обговаривал план прорыва тоннеля между Лондоном и Бомбеем… - за что потянется трясущаяся рука проголосовать: за Аравидзе или против?!
Если все оппозиционные телеканалы вырублены, сотрудники отлуплены и запуганы, а владельцы канала в марафонских бегах, то смотрит народ и оттопыривает уши для развесистой лапши разве российского Первого канала, который тоже вырублен (как и НТВ, Euronews, и прочие «вражеские экраны»)? Нет же – внимает он оперному пению все того же Аравидзе! А через бесконечное количество часов такого «прослушивания» у нашего зрителя рассудок переходит в состояние автопилота и голосует как запрограмированно.
Иными словами, в безвоздушной среде ничего не выживает, а в среде, где отсутствует устойчивая свобода – нет никакого выбора, никаких выборов. Только анаэробные бактерии гнили. Нет такого феномена как «свободные выборы» в среде, где происходят события 7 ноября – 1917 или 2007 года. Нет свободных выборов, когда есть хотя бы один политзаключенный. Нет свободных выборов, когда нет в обществе полного набора институтов свободы, демократии, прав человека, власти закона.
Совершенно не обязательно водевильно подбрасывать бюллетени или их проглатывать, запивая дежурной водой. В СССР на выборах в самом деле голосовали 99,99% и голосовали «за». Подтасовки в недемократическом обществе это сама норма, сам смысл такого общества, ими пронизано все, даже собственный интерес. Стремясь защитить сломанную волю и изнасилованный Божий дар выбора, человек цепляется за подбрасываемые ему насильником иллюзии-оправдания. Например, «коммунизм» и «светлое будущее». Или «товарищ Сталин, Ким Ир Сен, Ким Сен Ир». Или «Путин». Или «Миша Са-ах какой жених!». В состоянии удушья, человек вдыхает и вонь национализма и смрад чванства и весь туалет идеологии банановых диктатур. В онемении своей души ему везде виднеется рука врага, хотя это рука собственного батона опорожняет его карман. Человек, когда он на коленях, не может поспешить за духовным гидом, знакомящим его с миром избранничества. Такой человек может либо высматривать клопов в своем пятом углу, либо беззаветно любить Власть. Голосование превращается в род любовного акта, почти порнографию с обязательным рефреном «дас ист фантастиш!».
Выборы считаются демократическим чародейством не потому, что урна прозрачная или бюллетень призрачный, а потому что - квинтэссенция большого демократического паломничества, когда гражданское общество растет и совершенствуется навстречу своему выбору.
