Thanks for your answers. Can you explain in layman’s terms how researching biochemistry and FRET-based probes relates to what Nino will be doing? Is the new position also research in Biochemistry?
Currently Nino’s visa is a research scholar visa for up to five years. She was not originally subject to the 2-year home residency requirement, however there would be a 24-month repeater bar on any J-1 Visa. With a change in working title and a change in funding, she may become subject to these restrictions once in the new position, but they will not hinder the transfer.
The best seamless transition possible is to transfer Nino into the Post Doctoral Researcher position at the end of his current visa 06/07/2012. We can request this for one year at a time, or for the expected two years now, so nothing more would need to be done later. There are no restrictions on your end on the J-1 Visa, if her work is unsatisfactory and the appointment only lasts one year he simply leaves and the visa is ended.
If Nino plans to leave the U.S. after his current J-1 Visa ends, her only option to return would be a 6-month, short-term, J-1 visa or an H-1B Visa. If she leaves the U.S. both of these options will take a little time to process to get her back. The J-1 Visa will take about 1-2 months, whereas the H-1B Visa could take up to 9 months.
