Bilateral security agreement between Ukraine and the United States of AmericaUkraine and the United States of America (hereinafter referred to as the "Parties"):
Underscoring our shared commitment to an integrated, free and peaceful Europe;
Asserting that the security of Ukraine is an integral part of the security of the Euro-Atlantic region;
Recognizing the need to preserve and develop Ukraine's sovereignty, democracy and ability to deter and respond to current and future external threats;
Reaffirming their desire to expand cooperation in the field of defense and security, trade and investment ties, as well as to deepen general friendly relations between them;
Building on the current security partnership with the Armed Forces of Ukraine, which is being developed within the framework of the Strategic Defense Framework between the US Department of Defense and the Ministry of Defense of Ukraine, signed on August 31, 2021, and the Ukraine-US Strategic Partnership Charter, signed on November 10, 2021;
Recalling the long-term security cooperation between the Parties and the provision of military and security assistance by the United States, support of Ukraine with weapons, equipment and training necessary for defense against Russian aggression;
Welcoming the efforts of Ukraine aimed at achieving a just and sustainable peace, and emphasizing the commitment of the Parties to the pursuit of a just end to the war based on the principles of the UN Charter and respect for the sovereignty, independence and territorial integrity of Ukraine within its internationally recognized borders, including its territorial waters, and recognizing Ukraine's inalienable right to self-defense, enshrined in Article 51 of the UN Charter;
Reaffirming that Ukraine's future is in NATO, reaffirming its support for the Allies' declaration at the 2023 Vilnius Summit that Allies will be able to extend an invitation to Ukraine to join the Alliance when Allies agree and conditions are met, stressing the importance of deepening its integration into the Euro-Atlantic community and emphasizing the centrality of reforms to support and strengthen defense, prosperity, recovery, rule of law and democracy in Ukraine;
Emphasizing the importance of holding Russia accountable for its aggression against Ukraine, in particular by supporting Ukraine in seeking compensation for damages, losses and harm caused by Russian aggression, as provided for in the Statute of the Register of Damages Caused by the Russian Federation's Aggression Against Ukraine, and holding individuals accountable , guilty of war crimes and other international crimes committed in or against Ukraine, in accordance with international law;
Underscoring the continued efforts of the United States to use sanctions and export controls to increase the costs of Russia's aggression against Ukraine, and to work with its partners to explore all possible avenues through which immobilized Russian sovereign assets can be used to support Ukraine, in accordance with national and international law;
Adhering to the joint commitments made within the framework of the Joint Declaration on Support for Ukraine dated July 12, 2023 (hereinafter referred to as the "Joint Declaration of 2023");
Agreed on the following:
Article I: Principles of cooperation
This Agreement is based on the following principles and beliefs shared by the Parties:
Cooperation between the Parties is based on the principle of full respect for the independence and sovereignty of each of the Parties, as well as full respect for the Parties' obligations under international law and the goals and principles of the UN Charter.
Cooperation between the Parties is strengthened by their shared commitment to democracy, the rule of law, human rights, transparency and accountability.
Cooperation between the Parties is aimed at strengthening Euro-Atlantic security, stability and prosperity by strengthening integration and interoperability in the sphere of deterrence and defense.
Article II: Defense and Security Cooperation
The Parties' defense and security cooperation is based on their shared commitment to stability and peace in Europe.
It is the policy of the Parties to work together to contribute to deterring and resisting any future aggression against the territorial integrity of either Party. The security commitments contained in this Agreement are aimed at supporting Ukraine's efforts to win the current war and deter future Russian military aggression. It is United States policy to help Ukraine maintain a credible defense and deterrence capability.
Any future aggression or threat of aggression against the sovereignty, independence and territorial integrity of either Party will be a matter of serious concern to the other Party.
A. Capabilities of the future Defense Forces of Ukraine
The United States is committed to supporting Ukraine in building a modern, operationally compatible defense force with NATO, capable of reliably deterring and, if necessary, protecting against future aggression. It is expected that the future Defense Forces of Ukraine will rely on both modern equipment and equipment that was in service. In order to maintain the stability of the Ukrainian Defense Forces, both sides intend to standardize equipment in all their formations.
The United States intends to support Ukraine's military strength and the development and transformation of its military capabilities across the spectrum of combat functi0ns by providing weapons, equipment, training, and other assistance in coordination with partners, including in the following areas:
Air and Missile Defense: Building on the air defense assets that the United States has provided to date, including the Patriot system, the United States is committed to supporting Ukraine in building a multi-layered, integrated air and missile defense system. Both sides intend to take further steps to transition to a modern Ukrainian air defense architecture with appropriate radars, interceptors and support equipment across the spectrum of capabilities from tactical to strategic levels.
Firepower: The United States is committed to supporting Ukraine in developing a joint firepower capability, including the acquisition of land-based systems, munitions and guidance for indirect and long-range fire, and unmanned aerial vehicles. Both sides intend to continue procurement of munitions stocks for use by Ukraine in coordination with allies and partners, while developing domestic munitions production capacity in Ukraine.
Ground Maneuver: The United States is committed to supporting the development of Ukraine's doctrine and capabilities in the area of movement and maneuver, including the support of existing armored, mechanized, and motorized forces and assets, and to work with allies and partners to support the acquisition of modern platforms to meet Ukraine's needs maneuver forces
Air Force: The United States commits to coordinate with Ukraine and work, primarily through an allied consortium, to modernize the Ukrainian Air Force, including the procurement of modern fighter squadrons, provisioning, arming, and appropriate training to support fourth-generation fighter capabilities (including, but not limited to but not limited to F-16 multirole aircraft), as well as other airspace capabilities such as transport and intelligence, surveillance and reconnaissance platforms (including unmanned).
Maritime: The United States, in coordination with allies and partners, is committed to supporting improvements in Ukraine's ability to defend its territorial waters and contribute to regional security in the Black Sea through means that may include coastal defense systems, maritime reconnaissance, unmanned systems, and surface vessels. in particular, patrol and river ships, naval firearms, mine countermeasures at sea and other types of weapons that will contribute to the strengthening of maritime security in the Black and Azov Seas, as well as help Ukraine in exercising sovereignty over territorial waters, sovereign rights and jurisdiction in its exclusive economic zone.
Cybersecurity and Protection of Critical Infrastructure: The United States is committed to supporting Ukraine's ability to strengthen the cybersecurity and protection of its critical infrastructure and government information assets, including by strengthening cyber defenses against malicious cyber activities by Russia and other hostile state and non-state actors. Both sides commit to working together to improve Ukraine's ability to detect and eliminate intrusions, including through the use of technical assistance from the United States. The United States intends to help Ukraine increase the cyber resistance of critical infrastructure, especially energy facilities, to airstrikes, as well as support the rapid recovery of destroyed infrastructure, including the provision of logistical assistance.
Command and Control: The United States is committed to supporting Ukraine in developing command and control capabilities through the provision of both material and non-material support. Both sides recognize that the implementation of NATO-compatible communication systems, doctrine and organization is necessary to improve intelligence, early warning and timely allocation of resources for combat operations in Ukraine.
Affordability: The United States, in coordination with allies and partners, is committed to supporting Ukraine's ability to maintain and self-sustain its Defense Forces over the long term, maximizing their operational freedom of action. Such efforts may include logistics support, HR services, etc
